Return and Refund Policy

Dear Customers:

Welcome to www.nirmanbandhob.com the e-commerce website of LafargeHolcim Bangladesh Limited.

These Terms and Conditions govern your use of www.nirmanbandhob.com and the services provided by it. By accessing, viewing, or using this website, www.nirmanbandhob.com, you indicate that you understand these Terms and Conditions and accept them as the legal equivalent of a signed, written contract, binding you to these Terms and Conditions.

The Company reserves the right to amend/modify these Terms and Conditions at any time.  

  1. Definitions and Interpretation        

The following words shall mean and include as defined as below:

Bagged Cement” shall mean various Brands, types and grades of cement produced and/or traded by the Company packed in 50 kg bags;

Brands” shall mean the cement Brands of the Company, which is produced and marketed by the Company;

Customer” shall means a person who places an Order of the Products at the E-commerce Website of LHB.

Company“ or “LHB” shall means LafargeHolcim Bangladesh Limited.

Delivery Point” shall mean the address at which the Product will be delivered to the Customer.

 “Effective Date” shall mean the date on which the Order Confirmation is issued by the Company

E- commerce Website of LHB”: shall mean www.nirmanbandhob.com, the e-commerce website of the Company.

Minimum Order Quantity” shall mean Cement is delivered in bags and the Minimum quantity of bags that are required to be Ordered. Minimum Order Quantity is based on location. Please refer for the ecommerce Website for the Minimum Quantity at your location.

Order” shall mean when a Customer, places a request to purchase a Product at LHB ’s Website, and make the full payment for it.

Order Confirmation” shall mean that any Order placed at the Website is subject to acceptance by LHB. If the Order is accepted, the Customer shall receive a confirmation email and a message at mobile phone number (SMS) provided by the Customer to inform that the Order has been received and accepted. 

Order Cancelation means that the Company reserves the right at any time, after receiving your Order, to decline or cancel the Order (in whole or in part) for any reason whatsoever.

Product(s)” shall mean Bagged Cement of the Brands produced and marketed by the Company at the E- commerce Website of LHB

Price” shall mean the selling price of the Product(s) as mentioned in the website. The Price is based on the location. LHB reserves the right to change prices at any time at the E Commerce Website and is more elaborately explained in clause.

Refund” shall mean that in event of an Order Cancellationthe amount received for the Product is returned to the Customer.

Sales” shall mean Product(s) sold and delivered by the Company to the Customer after the Company receives the payments of Price for the Product(s) from the Customer

Sales Order” shall mean the Sales Order generated by the E- commerce Website of LHB with necessary details including a reference number, quantity of Product(s), Delivery Point, mode of Delivery etc. The Sales Order is generated after the Payment has been made and the Order has been confirmed.  

Standard Delivery Time” shall mean (Two) 2-working days from the Effective Date.

 “Effective Date” shall mean the date on which the Order Confirmation is issued by the Company.

Terms and Conditions” means the Terms and Conditions of the use of www.nirmanbandhob.com the e-commerce website of LHB.

Trademarks” shall mean the trademarks owned by and registered in the name of the Company or in the name of Holcim Group or Cementos Molins Group; 

  1.     Products & Pricing

    

  1.  You will be able to see the full list and details of the Product in the E-commerce Website of LHB    The Product prices are based on the location you select. LHB     reserves the right to change prices at any time.    

        
  2.  When you select a Product at    E-commerce Website of     LHB, place a request to purchase it, and make full payment for it you are making an Order.

        
  3.  The Order is subject to acceptance by LHB. If your order is accepted, you shall receive an     Order Confirmation email and a message at mobile phone number (SMS)     provided by you to inform you that your    Order has been received and accepted. Each Order Confirmation shall include a Sales Order Number. In case you have not received an Order     Confirmation e-mail and SMS, please call 16319(09:00 hours to 21:00     hours, Saturday-Thursday) or email us at     customerservice.bd@lafargeholcim.com.     Before Order Confirmation, we may need additional details and information from your side.    

        
  4.  The Company reserve the right at any time, after receiving your Order, decline or cancel your     Order (in whole or in part) for any reason whatsoever. In such case,  the payment made by you shall be refunded.   

  1.     Minimum Order Quantity      

Cement is delivered in bags. Please refer for the table below for the Minimum Order Quantity at your location.

  1.     Time for making delivery  

  1.   Product delivery will be done within 48 Hours (2 working days) from the Effective date, i.e., the date of Order Confirmation. The delivery time may vary depending on the situation, Order size and delivery location. You acknowledge that Delivery Time is non-binding.

        
  2.  Delivery Time may also vary depending on the availability of the Product and the destination to which you want the Product to be delivered.

        
  3. Delivery may take longer due to Bad weather, Political disruptions, Other unforeseen circumstances, Restrictions placed by the Government/ local authorities due to the ongoing pandemic. In such cases, LHB will proactively reach out to you. Please check your e-mails and SMS     regularly for updates.

        
  4.   The delivery of the Order will be undertaken only once at the address as provided in the Order received by the Company. In the event the delivery is not executed due to any reason whatsoever not attributable to LHB, the customer shall still be charged for the Order and no redelivery or refund will be made by LHB. The Order will be deemed executed and delivered     in the following events    

  1.    Wrong shipping/delivery address    

  2.    Recipient not available.   

  3.    Premises locked. 

  4.    Recipient refusing to accept the delivery.    

  5.    If no permission for truck access in restricted areas    

  6.    Truck accessibility of delivery sites (Road construction/Narrow roads etc).

  7.    The delivery location cannot be changed. 

  1. Returns and Refund Policy      

  1.  LHB is committed to maximize customer satisfaction.

        
  2.  We allow return of (select) Product bought at the E-commerce Website of LHB    only under the following conditions:    

  1.   The Product delivered is different from the Product ordered (as written in Product detail).

        
  2.   At the time of delivery if the  Product packings is found to be damaged/defective or any quality issue like lumps of cement or water penetration is there.

        
  3.   If any Product is fully or partially found to be damaged/defective or quality issue after receiving the Product, the complaint has to be raised within 48     hours of delivery via email to nirman.bandhob@lafargeholcim.com    or call to 16319 mentioning the order number and delivery challan number. Based on the complaint a dedicated Technical team will do the physical verification and based on their RCA (root cause analysis) report Product shall be replaced partially or fully to the customer end.

Returns will not be accepted:   

  1. The     Product has been tampered with, mishandled, stored inappropriately after the delivery. 

  2. Partial or full replacement will not be done after raising a complaint if the     Product is not found during physical verification or the Product consumed by the customer.   

  3. Partial replacement will not be done after raising complaint if the Product is not available during physical verification by technical team and replacement by logistics.

        
  4.  We do not accept partial returns. For example, if you ordered 200 bags of cement, and used up     150 of those, you cannot return the 50 unused bags.

        
  5. If replacement of the returned Product is unavailable, we will refund the customer the amount that has been paid for the material and the refund will be carried out through online bank transfer.

        
  6. No return and refund will be done if the consumer cannot raise complaint with a valid order number/delivery challan number bought from nirmanbandhob.com.

        
  7. No return and refund will be processed if any complaint raised after 48     hours of receiving delivery with customer acknowledgement.    

  1. Substitution Policy

In an event where a Product that you have ordered is out of stock or unavailable, we will contact you to give an option of an alternate Product. If you don’t respond to our Query within 24 hours, we will cancel the order and refund the payment may by you. 

  1. Order Modification/Cancellation Policy    

  1.  If the Company cancels all or a part of your Order, after you have made the payment, a refund shall be made to your credit/debit card or bank account for the     amount charged for the canceled portion of the Order.    

        
  2.  In case you want to modify/cancel an Order, you can reach us on 16319    (09:00 hours to 21:00 hours, Saturday-Thursday). If the order has not been processed for delivery, we will try to modify/cancel the order for you. If the Order has already been processed /dispatched,     it cannot be cancelled/modified and you will be charged for the     Order.

        
  3.   In cases of Order modification/cancellation, please communicate with us within 4 hours of Order. Before canceling any Order, we will contact you.

        
  4.  It will not be possible for us to accept any request for Product exchanges, i.e.  Provide one Brand     Product instead of another. Order, once placed shall be treated as final.   

  1. Payment Terms      

  1.  You agree to pay the Price applicable for the Product on the E-commerce Website of LHB at the time you submit your Order via your chosen payment gateway.

        
  2.  You will be solely responsible for payment of all taxes & VATs (other than taxes based on LHB's income), arising from the purchase of the Products and services     (Taxes) not withheld by LHB.    

        
  3.   All payments are non-refundable (except as expressly set forth in the Terms and     Conditions).

        
  4.   Order Confirmation shall not be processed until; the full payment for the Order is not received by the Company.    

        
  5.   We accept payment through payment gateway, net banking, direct bank transfer (RTGS/BFTN).

        
  6.  If you are unable to pay via payment gateway, Kindly contact customer care 16319 for help.

        
  7.  In case of Order Cancellation,     the money shall be returned to the Customer (if purchased through debit/credit card or bank transfer) within 10 days, from Order cancellation date.        

  1. Communications

You agree to receive communications from us by e-mail, SMS or any other communication made electronically, or physically through post. You agree that all agreements, notices, disclosures and other communications that LHB provides to you by e-mail or in any other aforementioned mediums satisfy any legal requirement that such communications be in writing.

Since we are in a building material business, we would like to update you on the range of Products. You give your consent for us to contact you through SMS, phone call and email on your phone number and email id.

  1. Feedback and Suggestions

At LHB, we make every effort to ensure that you receive excellent Products and services. We strive hard not only to meet, but exceed your expectations. If, at any time, you experience problems with an Order or are not happy with our service, you can call us on 16319.   

  1. Force Majeure

LHB shall be relieved from the consequences of failing to perform its respective obligations under the Order, to the extent that such failure is the result of occurrence of an event of Force Majeure. For the purpose of the Order event of Force Majeure shall mean:

  1.    war, (declared or undeclared),     insurrection, civil war or hostile action;

  2.    acts of public enemy;

  3.    acts of God;

  4.    events or occurrences beyond     the reasonable control of the Parties;

  5.    strikes, lockouts or other     industrial disturbances interrupting services and supplies;

  6.    acts of Governments of     Bangladesh or outside Bangladesh;

  7.    could not reasonably have been     foreseen or provided against;

  8.    earthquake, fire, flood,     cyclone, epidemics, pandemics and the like or another natural disaster,

        
  9.    Any other event attributable as Force Majeure.

If the force majeure event continues for more than 30 days, either LHB or the Customer shall have the right to terminate the Order with immediate effect.


  1. Governing Law


The validity, interpretation and implementation of the Agreement shall be governed by, and construed in accordance with, the laws of the People’s Republic of Bangladesh.

  1. Jurisdiction


LHB retains the right to refuse any Order unconditionally. All claims are subject to the jurisdiction of Court at Dhaka, Bangladesh only.

  1.   Terms of     Use of the Website

  2.    These     Terms of Use apply to all users of the Website. The Website may include content, information or links to third parties or third-party websites like architects, engineers, contractors, distributors and mason.

By accepting these Terms of Use you agree to hold harmless and relieve LHB and its affiliates from any liability whatsoever arising from your use of information from a third party or your use of any third-party website and you agree and acknowledge that viewing and usage of the contents of any such third party website is solely made at your own risk.    

  1.    LHB     recommends that before you disclose any personal information to a     third party, you should first read and accept the third party's privacy policy and Terms of Use of use (if applicable) of their website.

        
  2.    The Privacy Policy forms an integral part of the Terms of Use. The policy is enclosed as    Annexure “A”       

  1. Value-Added Services    

LHB offers a platform to architects, engineers, contractors, distributors and masons to register and directly communicate with the customer and offer their valuable services. Our program is an excellent way of linking and converting traffic, effective marketing strategy and a great way to sell services online. You have to agree upon the payment terms and modes with the Service Provider/ customers outside this platform, LHB will not be liable for any service and payment.

Privacy policy for the Website   

  1.    LafargeHolcim     Bangladesh Limited (hereinafter referred to as the ‘Company’) is committed to respect privacy of every person, including employees of the Company, business partners as well as vendors, dealers,     Customers and all others who share their sensitive personal data or information (‘Sensitive     Personal Information’)     with the Company.

        
  2.    This privacy policy (‘Policy’) is applicable, businesses partners/associates, vendors, dealers,     customers etc. (‘Information     Providers’),     who disclose Sensitive Personal Information to the Company for lawful business requirements of the Company at the Company’s website.

        
  3.    The purpose of this Policy, as amended from time to time, is to give the     Information Providers an understanding on how the Company intends to collect, receive, possess, store, transfer, handle, deal with and use the Sensitive Personal Information provided.

        
  4.    Sensitive     Personal Information of the Information Providers may be required to be collected, maintained and transferred for business and official purposes with the consent of the Information Providers. Such     Sensitive Personal Information may have to be shared with other     Group Companies or third party, within and outside the country, as per lawful business requirements of the Company.    

  5. The     Company shall ensure confidentiality of such Sensitive Personal     Information and grievances, if any, related to such issues can be     raised to the customer care customerservice.bd@lafargeholcim.com            

  6.  By filling up your details in this website the Information Providers shall consent to the collection, storage, usage, disclosure, processing and transfer of their Sensitive Personal Information provided to the Company for the purposes mentioned in this Policy.    

  7. The Information Providers have the option of not providing their     Sensitive Personal Information sought to be collected if they do not agree with this Policy or even otherwise. Further, the Information     Providers also have the option to withdraw their consent given earlier, provided such withdrawal of consent is intimated in writing.

What information Company may collect?

The Company may collect the following types of Sensitive Personal Information, including but not limited to name, contact details, financial details, passwords used for company-provided websites/web pages:

1. Customer registration information:    

  •    Mandatory     field: Name,     Email, Phone number, Address with district & Thana, Delivery     address         

  •    Optional     Field: National     ID number, National ID upload option

2. Architect/Engineer registration information:    

  • Mandatory     field: Name,     Email, Phone number, Address with district & Thana, IB member     ID, Years of experience, Service, Service change & Payment  option     

  •    Optional  Field: Landmark     project

 3. Contractor registration information:   

  • Mandatory Field: Name,     Email, Phone number, Address with district & Thana, Trade     license number, Years of experience, Service, Service change &    Payment option      

  •    Optional Field: Landmark     project

 4. Distributor/Retailer/Shojon registration information  

  • Mandatory  field: Name,     Email, Phone number, Address with district & Thana, National ID card & Trade License     

5. Mason registration information:    

  • Mandatory field: Name,     Phone number, Address with district & Thana, Years of experience

Purpose of collection:   

  1.  The     Company shall use your personal data for providing you the products and services the Company offers. To do so, the Company keeps records of your business with us and manages your account. The Company may also contact you for customer assistance and service purposes or to inform you about our products and services. If you do not provide us with your personal information, the Company will be unable to provide you with the requested Products or services.

        
  2.  The     Company will also process your personal data where the Company are required to do so by law (e.g. to keep sales records for tax purposes) or where you have expressly permitted us to do so.

Sharing and transferring of Sensitive Personal Information:    

  1.    The     Company may need to share the Sensitive Personal Information with group companies within and outside Bangladesh, business associates     and/ or third parties within and outside Bangladesh in connection with the lawful purposes, as mentioned above.   

  1.    The     Information Providers authorize the Company to exchange, disclose,     transfer, share, part with the Sensitive Personal Information and/or any information provided, within or outside Bangladesh for the above purposes.

Security:  

  1.    The     Company has adopted reasonable security practices and procedure to ensure that the Sensitive Personal Information is collected and preserved in a secured manner. In case the Information Providers wish to know more details about the adopted reasonable security practices and procedures, they may contact the designated person for the same.

        
  2.    While the Company will endeavour to take all reasonable and appropriate steps to keep secure any information and prevent its unauthorized access, the information providers agree and acknowledge that the     Company cannot provide any absolute assurance regarding the security of the Sensitive Personal Information. To the fullest extent permissible under applicable laws, the Company disclaims any liability in relation to any breach of security or loss or disclosure of information in relation to the Personal Information.

        
  3.    If the     Information Provider needs to access update or correct the Sensitive     Personal Information, he/she may contact the designated person for the same.


Data Retention:

It is the Company’s policy to retain Sensitive Personal Information of the Information Providers only for as long as the Company believes it to be necessary for the purposes for which such Sensitive Personal Information was collected, subject to any legal requirements for the information to be retained for longer period, if any.

Changes to this Privacy Policy:

The Company reserves the right to revise and update this Privacy Policy at any time without expressly informing the Information Providers. Any such revisions will be effective on and from the date of posting the same to the intranet/internet website of the Company, and will apply to all information collected both prior to and following the effective date. You should visit the website periodically to review the current policies with regard to Sensitive Personal Information.
